Modern House Miami Consulting Agreement
This Consulting Agreement ("Agreement") governs all consulting services provided by Modern House Miami LLC ("Modern House Miami," "Company," "we," "our," or "us") to any client ("Client," "you," or "your").
By purchasing, scheduling, or participating in any consultation, review, report, virtual meeting, or advisory service, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
This Agreement should be read together with our Terms & Conditions, Privacy Policy, Website Disclaimer, Refund & Cancellation Policy, and any proposal or invoice provided to you.
1. Scope of Services
Modern House Miami provides independent consulting and educational services designed to help homeowners, buyers, investors, and design professionals make informed decisions regarding residential properties.
Services may include, but are not limited to:

Each engagement is limited to the scope described in your booking confirmation, proposal, invoice, or written agreement.
Additional work requested outside the agreed scope may require a separate agreement and additional fees.

We do not provide:

Medical advice
Our role is to provide strategic recommendations intended to improve functionality, lifestyle, aesthetics, organization, and long-term property potential.
Clients remain solely responsible for all implementation decisions.
3. Independent Advice
Modern House Miami acts as an independent consultant.
Unless specifically disclosed in writing, our recommendations are not influenced by retailers, manufacturers, contractors, suppliers, or affiliate relationships.
Our objective is to provide recommendations that we believe are in the best interest of the client based upon the information available at the time of the consultation.
4. Client Responsibilities
To enable us to provide meaningful recommendations, clients agree to provide complete and accurate information.
This may include:

Measurements
-
Property photographs
-
Videos
-
Architectural drawings
-
Existing layouts
-
Budgets
-
Lifestyle preferences
-
Renovation objectives
-
Site constraints
Clients acknowledge that inaccurate or incomplete information may materially affect our recommendations.
Modern House Miami is not responsible for errors arising from inaccurate information supplied by the client or third parties.
5. Floor Plans and Measurements
Unless expressly stated otherwise, Modern House Miami does not independently verify measurements or drawings supplied by clients.
Clients acknowledge that:

Measurements may contain inaccuracies.

Existing drawings may not reflect current site conditions.

Furniture dimensions should always be verified before ordering.

Cabinetry, appliances, and construction details must be confirmed by qualified professionals before installation.
Clients are solely responsible for verifying all dimensions before construction or purchasing materials.
6. Luxury Home Intelligence™ Reports
Luxury Home Intelligence™ Reports are professional consulting documents prepared using information available at the time of review.
Reports are intended to provide strategic guidance regarding:

-
Lifestyle optimization

Organization
-
Lighting
-
Storage
-
Material selection
-
Furniture planning
-
Long-term flexibility
-
Property appeal
Reports do not constitute architectural plans, engineering documents, construction drawings, or permit-ready documents.
Implementation remains solely the responsibility of the client and their licensed professionals.
7. AI-Assisted Analysis
Certain reports or services may incorporate artificial intelligence tools to assist with research, organization, visualization, or preliminary analysis.
AI is used solely as a productivity tool.
Final recommendations are reviewed using professional judgment before delivery whenever reasonably practicable.
Clients acknowledge that AI systems may generate inaccurate, incomplete, or unsuitable information.
Accordingly, all recommendations should be independently verified before implementation.
8. Home Value and Investment Disclaimer
Modern House Miami may discuss strategies that could improve a property's functionality, buyer appeal, or long-term marketability.
However, we make no representation or guarantee that our recommendations will:

Increase property value

Increase resale price
-
Accelerate a sale
-
Improve rental income
-
Increase investment returns
-
Reduce renovation costs
Real estate markets are influenced by numerous factors beyond our control.
Any investment-related discussions are educational in nature and should not be interpreted as financial or investment advice.
9. Product Recommendations
As part of our consulting services, we may recommend products, furnishings, fixtures, finishes, appliances, lighting, technology, or other items.
Our recommendations are based on professional judgment and available information.
We do not manufacture, distribute, install, or warrant third-party products.
Clients remain responsible for evaluating whether recommended products meet their individual needs, budgets, local building requirements, and installation conditions.
10. Third-Party Professionals
Clients may choose to engage architects, designers, contractors, builders, installers, or other professionals to implement recommendations.
Modern House Miami is not responsible for:

Contractor performance

Construction quality
-
Installation errors
-
Building code compliance
-
Permit approvals
-
Engineering decisions
-
Municipal inspections
-
Delays
-
Cost overruns
-
Warranty claims
Any contract between the client and a third-party professional is entirely separate from this Agreement.
11. Virtual Consultations
Many consulting services are provided remotely via video conference, telephone, email, or other electronic communication.
Clients acknowledge that remote consultations may have limitations compared to on-site inspections.
Recommendations are based solely upon information visible or provided during the consultation.
We are not responsible for hidden conditions or information not disclosed by the client.
12. Confidentiality
Modern House Miami respects the privacy of our clients.
Except as required by law or with the client's written consent, we will not intentionally disclose confidential project information, floor plans, photographs, or personal information to third parties.
Internal use of client materials is limited to providing the requested services, quality assurance, administrative purposes, and legal compliance.
Clients retain ownership of the materials they provide.
Modern House Miami retains ownership of all reports, analyses, recommendations, presentations, and intellectual property created during the engagement.
